Justice Gorsuch on the Past and (Uncertain) Future of Chevron

Last summer, Justice Neil Gorsuch, in a concurring opinion issued by the Tenth Circuit Court of Appeals, expressed a critique of the “Chevron Doctrine,” under which courts are to defer to the interpretation of statutes by federal agencies that administer and promulgate regulations.  Justice Gorsuch wrote that the doctrine empowers bureaucrats to "swallow huge amounts of core judicial and legislative power" and "concentrate federal power" in a way that contradicts the intention of the framers of the Constitution. 

 

University of Dallas Professor and STMS Board member David Upham will critically assess how Justice Gorsuch’s appointment to the Supreme Court may cause a fundamental reassessment of administrative law.
